Snapped Up Terms & Conditions
- COPYRIGHT:
1a. The entire copyright of any photographs is retained by the photographer at all times throughout the world unless agreed in writing for an additional fee.
- OWNERSHIP OF MATERIALS:
2a. Title to all photographs remains the property of the photographer.
- USE:
3a. The Licence to Use comes into effect from the date of delivery of the photographs.
3b. The Licence only applies to the client and its benefit shall not be assigned to any third party without the photographer’s permission.
3c. The client will be authorised to publish the photographs on dating websites and on the client’s social media, and to use the photographs for other personal purposes only. Accordingly, the photographer’s permission must be obtained before any use of the Photographs for any commercial purposes.
3d. Permission to use the photographs for purposes outside the terms of the Licence will normally be granted upon payment of a further fee, which must be mutually agreed (and paid in full) before such further use. Unless otherwise agreed in writing, all further Licences in respect of the photographs will be subject to these terms and conditions.
3e. Unless agreed in writing in advance of the photo shoot, the photographer may use photographs taken during photo shoot of the client as part of the photographer’s business advertising. This includes the Snapped Up website, social media accounts and printed material.
4.BOOKING, PAYMENT AND FEES:
4a. In order to book a photo shoot, the client will contact the photographer and request his/her preferred dates, approximate times, package and location for the photo shoot, using the booking form on this website. The photographer will respond within one working day (although usually much sooner), proposing an exact time and location for the photo shoot. Upon the client and the photographer reaching agreement on a time, the photographer will send the client a PayPal invoice.
4b. A booking is considered firm as from the time of payment. Once a booking is considered firm, the photographer will not accept any other work from other clients for that time and date.
4c. Full payment by the client will be expected at the time of booking.
4d. In order to guarantee a specific time slot for a photo shoot, payment must be made by the client within one hour of a booking time being agreed.
4e. Fees are inclusive of VAT at the rate applicable at the time of booking.
4f. The photographer’s fees may change, however any change in fees will not affect bookings where payment is already received.
- EXPENSES:
5a. Within the standard packages, additional expenses are unlikely. However, if extra expenses or time are incurred by the photographer as a result of alterations to the original brief by the client, or otherwise at their request, the client shall give approval to and be liable to pay such extra expenses or fees at The photographer’s normal rate to the photographer in addition to the expenses previously agreed or estimated.
- CANCELLATION:
6a. If the client cancels a photo shoot more than 48 hours before the date of the shoot, the photographer will repay the total sum paid.
6b. If the client cancels a photo shoot less than 48 hours but more than 24 hours before the date of the shoot, the photographer will repay 50% of total sum paid.
6c. If the client cancels a photo shoot less than 24 hours before the date of the shoot, the photographer may retain all the fees paid.
6d. If the client cancels a photo shoot that has previously been rescheduled, the photographer may retain all the fees paid.
6e. If the client arrives late for the photo shoot, the photo shoot may continue for 10 minutes only beyond the scheduled end time.
6f. If the client does not appear for the photo shoot, the photographer may retain all the fees paid.
6g. Although incredibly unlikely, the photographer may cancel or reschedule the photo shoot at any time prior to the photo shoot.
6h. If the photographer is unable to attend a photo shoot due to any cause beyond their reasonable control e.g. sudden illness or injury etc., or in event of total photographic failure, liability shall be limited to a full refund of any fees paid to the Photographer by the Client at that time.
- RESCHEDULING:
7a. The client may reschedule the photo shoot once only.
7b. If the client reschedules the photo shoot more than 24 hours before the date of the photo shoot, no further fees are payable.
7c. If the client reschedules the photo shoot less than 24 hours before the date of the photo shoot, the photographer may retain 50% the fees paid.
7d. At the photographer’s discretion, the photo shoot may be rescheduled due to weather conditions. This must happen no less than 24 hours before scheduled time of the photo shoot.

PHOTOGRAPHER’S SERVICES:
8a. The photographer will provide the photographer’s services with reasonable skill and care.
8b. Photographs taken during the course of the photo shoot will be at the artistic and creative discretion of the photographer, although every effort will be made to comply with the client’s requirements.
8c. Light retouching, such as adjusting the white balance, exposure, crop, contrast, brightness and sharpness etc., as well as removing small marks such as blemishes, spots or stains are included within the photographer’s services. Heavy retouching or airbrushing is not included with the photographer’s service, although this may be arranged for an extra free if necessary.
8d. All final edited photographs, selected by the client, will be backed up by the photographer for one year.
8e. The photographer will, within seven working days of the photo shoot (although usually much sooner), upload a selection of unedited photographs to a private gallery for the client to select their final choices from.
8f. Once the client has selected their chosen photographs, the photographer will edit those photographs and will digitally send them to to the client within a further three working days.
- REJECTION:
9a. There is no right to reject on the basis of style or composition.

PHOTOGRAPHER’S LIABILITY:
10a. If the images are lost, damaged or stolen from the photographer, the photographer is not liable beyond one year of storage. Within one year, The photographer is liable to the cost of the originals (a return of the original fee). In the event of partial loss of images, a percentage of the total cost based on the percentage of damaged images will be returned to the client.
10b. The photographer is not responsible or liable for any loss, theft or damage to the client’s possessions during the Photo Shoot.
10c. The photographer is not responsible or liable for or injury sustained to the client during the Photo Shoot.
11. ELIGIBILITY:
11a. By booking a photo shoot, the client warrants that they are over 18 years old and have the legal authority to enter into these terms.
12. APPLICABLE LAW:
12a. This agreement shall be governed by the laws of England & Wales.
- VARIATION:
12a. These Terms and Conditions shall not be varied except by agreement in writing.
